These Terms and Conditions consist of two parts:

Part B: Booking & Service Conditions – which governs any booking you make with us.

These conditions apply to all bookings for tours, accommodation, or other services provided by us.
All prices are quoted in Australian Dollars (AUD) and are inclusive of Goods and Services Tax (GST), unless stated otherwise. Prices are subject to change without notice.
Bookings: To secure a booking, full payment is required at the time of booking, unless otherwise specified.
(Alternative Clause for Deposits) Bookings: To secure a booking, a non-refundable deposit of [e.g. 20%] of the total price is required. The final balance is due [e.g. 30] days prior to the service date. If a booking is made within this period, full payment is required.
Payment is processed through our secure third-party payment gateway.
a) Cancellation by You:
If you wish to cancel your booking, you must notify us in writing. The following cancellation fees apply:
Cancellation more than [e.g. 30] days before the service date: [e.g. Full refund less the non-refundable deposit or a 10% administration fee].
Cancellation between [e.g. 15 and 30] days before the service date: [e.g. 50%] of the total booking cost will be forfeited.
Cancellation within [e.g. 14] days of the service date: [e.g. 100%] of the total booking cost will be forfeited.
No-shows or failure to participate will be treated as a last-minute cancellation and no refund will be issued.
b) Cancellation by Us:
We reserve the right to cancel or alter services as required by operational, safety, or weather conditions. If we cancel a service prior to its commencement, you will be offered:
A full refund of all monies paid; or
A transfer to an alternative service date of equal value, subject to availability.
We are not responsible for any incidental expenses you may have incurred as a result of your booking, such as flights or accommodation. We strongly recommend you take out comprehensive travel insurance.
You agree to:
Disclose any pre-existing medical conditions, dietary needs, or physical limitations that may impact your ability to safely participate in the service at the time of booking.
Follow all lawful instructions from our staff during the tour or service.
Behave in a manner that is respectful and does not interfere with the safety or enjoyment of other guests.
We reserve the right to remove you from a tour or service, without refund, if your behaviour is deemed dangerous, illegal, or offensive.
You acknowledge that participation in tourism activities, particularly in the Kimberley region, involves a degree of inherent risk. To the extent permitted by law, you release us from all claims and liability for any personal injury, loss, or damage to property that you may suffer.
This release does not exclude our liability for death or personal injury caused by our negligence or for any other liability that cannot be excluded under the Australian Consumer Law.
We strongly recommend that you purchase comprehensive travel insurance at the time of booking to cover items such as cancellation, medical expenses, personal injury, and loss of property.
These Terms and Conditions are governed by the laws of Western Australia. You and Gubungarri Adventures irrevocably submit to the non-exclusive jurisdiction of the Courts of Western Australia.
